Trusts can be wonderful tools but selecting a trustee can be difficult. Most clients want specific people, trusted family members typically, not a bank or corporation to serve as trustees and make decisions on behalf of the trust beneficiaries. However, often these individuals are not prepared to manage assets as required by the trust and trust law. Further these individual trustees are personally liable for their actions. We have a process that allows these trustees to fulfill the trust creator’s desire that they make most decisions for the trust but insulate the trustee from liability with respect to investment management. The result is a trustee that knows and cars about the family and trust assets that are professionally and prudently managed in compliance with the trust and trust law.
